Pilot Participation Agreement (Wave 1)

1. Purpose of the Pilot

This pilot has been designed to help Australian grain growers understand their farm-level emissions and benchmark themselves against similar operations. It is not a commercial certification program or compliance reporting tool.

The pilot provides:

  • A digital carbon assessment experience.

  • A personalised “snapshot” emissions report.

  • Optional follow-up discussion or advisory support.

The pilot is offered to a limited intake of participants on a pre-MVP basis.
You are participating as an early adopter to help us test usability, accuracy, and value.

Overview (In Plain English)

Before the legal text, we want you to know a few important things:


You are in control.

You choose how detailed your inputs are.
You do not need invoices, receipts, or agronomist involvement.


Your individual results are private.

Your farm-level assessment belongs to you.

We do not disclose your identifiable results to buyers, government, or third parties.


Benchmarking is de-identified.

You may see how your results compare to similar growers.

No one will see your identity, and comparisons are based on de-identified, aggregated data.


This is not certification or compliance.

The insights we provide are advisory only.

They are early-stage indicators to help you understand emissions and opportunities.

They are not suitable for financial decisions, grant applications, environmental claims, or external reporting.

2. Definitions


“We”, “us”, “our”, “Herwitz Mueller”

Herwitz Mueller Pty Ltd (ACN 681 836 279), an Australian company headquartered in NSW.


“You”, “Participant”, “Grower”

The individual or organisation participating in the pilot.


“Pilot”

The structured, pre-MVP program offered to early users to test the assessment workflow and reporting.


“Assessment”

The process by which your farm data is collected and converted into emissions insights.


“Report”

The snapshot digital or PDF summary produced using your inputs.


“Minimum Viable Product” or “MVP”

An early-stage version of the platform with limited functionality, released for testing and feedback.

  1. Eligability

To participate in Wave 1 of the pilot, you confirm that:

  • You are an Australian grain grower operating a farm or enterprise.

  • Your farm practices are related to broadacre agriculture.

  • You are able to provide basic operational inputs (crop type, fuel use, crop residue, machinery, etc.).

  • You understand that the pilot is not a certification or compliance tool.

Herwitz Mueller reserves the right to decline participants if:

  • Data integrity issues are identified

  • There is misuse of the platform

  • There are conflicts of interest

  • We are unable to adequately support your assessment cohort

4. Scope of the Pilot

The pilot provides:

  • A one-off emissions assessment covering selected crops for a nominated season.

  • A personalised snapshot report delivered within five (5) business days of completing the assessment (subject to volume).

  • Optional follow-up advisory services (if offered).

The pilot does not provide:

  • Full life cycle assessments suitable for certification

  • Climate Active compliant reporting

  • Legal, agronomic, or financial advice

  • Procurement guarantees or market access agreements

  • Environmental product declarations

5. Your Data & Privacy

5.1 Ownership of Input Data

You retain ownership of the raw, factual operational data that you input into the platform, including farming practices, fuel usage, crop profiles, residue management, and other operational characteristics (“Input Data”).

Providing Input Data to Herwitz Mueller does not transfer ownership of that information.

5.2 Use of Input Data

You grant Herwitz Mueller a non-exclusive, royalty-free licence to use Input Data for the following purposes:

a) to conduct your assessment and generate your Snapshot Report;
b) to measure and analyse emissions performance;
c) to train and improve our models, methodologies, and analytics;
d) to produce aggregated and anonymised benchmarking datasets;
e) to deliver optional or follow-on services related to emissions insights, benchmarking, or advisory support.

This licence is necessary to operate the pilot program and deliver insights.

5.3 Derived Data & Analytics

Herwitz Mueller may generate datasets, benchmarking outputs, analytics, or insights derived from Input Data provided by multiple participants (“Derived Data”).

Derived Data is owned exclusively by Herwitz Mueller.

This includes:

  • emissions benchmarking models,

  • anonymised peer group statistics,

  • rate-based comparison metrics,

  • aggregated cohort performance indicators,

  • and any predictive, statistical, or comparative insights.

You acknowledge that you do not acquire ownership or IP rights in Derived Data, even if it is calculated using your Input Data.

5.4 Confidentiality of Individual Reports

Individual Snapshot Reports are confidential to you.
We will not disclose your individual results or identifying information to other participants, customers, government agencies, or third parties without your explicit written consent.

Your identity and farm profile are never disclosed in benchmarking outputs.

5.5 Anonymised Benchmarking

Herwitz Mueller may present anonymised benchmarking insights to participants as part of the platform or follow-on services.

Benchmarking may be presented as:

  • rate-based or normalised metrics, such as emissions per tonne, per hectare, or per unit of output;

  • statistical cohort ranges (e.g. 25th/50th/75th percentile);

  • directional comparisons (e.g. below / in-line / above cohort median).

Absolute production volumes, total emissions, headcounts, or other direct identifiers will not be disclosed.

5.6 Similar Farm Profiles

Where benchmarking groups are constructed, they may be based on non-identifiable characteristics, such as:

  • agro-climatic region,

  • soil type or rainfall patterns,

  • crop type,

  • general management practices,

  • or operational archetype.

Matching is algorithmic and cohort-based.
We do not reveal or imply the identity, location, or individual profile of any participating farm.

5.7 No Reverse Identification

Herwitz Mueller will take reasonable technical and procedural safeguards to ensure that benchmarking outputs do not allow:

  • reverse identification of participants; or

  • re-construction of farm identity through inference, triangulation, or external data sources.

5.8 Optional and Future Services

Comparative benchmarking, cohort insights, deep-dive reports, consultations, or advisory services may be offered after completion of the pilot assessment.

These services may rely on Derived Data.

They are optional, not included in the pilot fee, and do not disclose identifiable participant information.

5.9 Data Storage and Protection

Input Data and Derived Data are stored using secure digital infrastructure. We implement reasonable operational and technical measures to reduce risk of unauthorised access, misuse, loss, or disclosure.

No storage system is perfectly secure.

You agree to use the platform at your own risk and acknowledge that security cannot be guaranteed.

5.10 External Disclosure

We will not disclose your identifiable data to third parties, except:

  • when required by law or court order, or

  • when you expressly authorise disclosure in writing.

5.11 Withdrawal of Data

You may request deletion of your Input Data before completing and submitting the assessment.
Once the Snapshot Report is generated, deletion of Input Data may not be possible if it has already contributed to Derived Data or anonymised benchmarking models.

This is necessary to preserve model integrity, cohort statistics, and downstream analytical consistency.

6. Payment Terms

A participation fee is payable to secure your place in the pilot. For Wave 1, the fee is:

AUD $99 (including GST) — normally $250.

Payment unlocks access to the assessment and prioritises delivery of your report.

Except as required by law:

  • Fees are not refundable after inputs are submitted.

  • Fees do not constitute consideration for certification or compliance services.

Additional advisory services, deep-dive assessments or consultations (if offered) will be optional and charged separately.

7. Intellectual Property

7.1 Ownership

Herwitz Mueller owns all:

  • software

  • methodologies

  • assessment models

  • user experience design

  • analytics tools

  • platform-generated insights

You receive a limited, personal, non-exclusive right to use your report for your own business purposes.

You may not:

  • copy or reverse engineer the platform

  • resell access

  • claim commercial equivalency with third-party certification

  • publish our methodologies as your own

7.2 Report Output

You may share your report with trusted advisors. Please ensure they understand the limitations of the pilot.

8. Liability & Disclaimers

This pilot is an experimental, pre-MVP service.

We do not guarantee:

  • accuracy of all factors

  • completeness of inputs

  • fit for any specific purpose

  • compliance with regulatory frameworks

  • financial or crop performance outcomes

You acknowledge that:

  • emissions modelling relies on your inputs

  • results may materially differ from real-world performance

  • reports are advisory only

Maximum Liability

To the greatest extent permitted by Australian law:

Our liability is strictly capped at the total fees you paid for participation.

9. Withdrawal & Termination

You may withdraw at any time before submitting your operational inputs.

Herwitz Mueller may suspend or cancel access if:

  • misuse or hostile behaviour is detected

  • misinformation is entered knowingly

  • actions compromise pilot integrity

  • confidentiality is breached

If terminated due to misuse, no refunds will apply.

10. Publicity, Case Studies, Research

We will never publish your name, photos, farm details or property location without your written consent.

We may use aggregated and anonymised learnings to:

  • improve our platform

  • develop academic or technical models

  • communicate pilot insights to the industry

If you would like to be featured as a named case study, we will ask you separately in writing.

11. Future Services

Participation in this pilot does not:

  • guarantee access to future pilots

  • grant price locks or subscription entitlement

  • constitute certification

  • create a commercial partnership

You will always be free to opt out of future engagement.

12. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. Any disputes will be resolved through NSW jurisdiction.

Acknowledgement of Terms

To participate, you must explicitly accept these terms during registration.

“I agree to the Herwitz Mueller Pilot Participation Agreement.”

You should print or save a copy of this Agreement for your records.
