“We”, “us”, “our”, “Herwitz Mueller”

Herwitz Mueller Pty Ltd and its related parties.


“Platform”

The Herwitz Mueller software, website, and digital services.


“User”, “You”, “Customer”

Any individual or entity that uses the Platform or interacts with our services.


“Assessment”

The process by which user-submitted information is converted into insights, metrics, or analytics.


“Report”

Any output generated by the Platform, including summaries, analytics, benchmarking, or formatted files.


“De-identified Data” -

Information modified to remove direct identifiers so that it cannot reasonably identify an individual or business without additional information.

4. Platform Terms of Use

4.1 Eligibility

You must be:

  • At least 18 years old; or

  • A legally recognised business entity with authority to transact.

We may refuse access at our discretion.

4.2 Purpose of the Platform

The Platform is designed to:

  • Provide emissions-related insights

  • Benchmark operational performance

  • Facilitate sustainability-aligned decision making S

Unless stated, it is not a regulatory compliance system.

4.3 Account Creation

You must provide accurate information.

You are responsible for keeping login credentials secure.

We may suspend accounts for misuse or fraud.

4.4 Acceptable Use

You agree not to:

  • Reverse engineer or copy the Platform

  • Misrepresent or falsify data

  • Upload proprietary third-party information without permission

  • Attempt to access other users’ data Interfere with system performance or availability

5. Reports, Insights, and Limitations

5.1 Informational use

Unless clearly stated otherwise:

  • Reports are advisory only

  • Reports are not certification, compliance, or “carbon neutral” proof

  • Results are based on user inputs and modelling assumptions

5.2 External use

You must not use outputs for:

  • Environmental claims

  • Legal disputes

  • Regulatory filings

  • Trading instruments

  • Public marketing

Unless you have a separate signed agreement with us.

6. Data & Privacy Principles

You may provide:

  • Fuel, energy, or input usage

  • Yield or production outcomes

  • Supply chain details

You retain ownership of your raw input data.

  • Provide benchmarking views

We do not:

  • Sell your raw data

  • Publish your identifiable results

  • Share operational specifics with competitors

6.3 Benchmarking

Benchmarking is:

We do not display:

  • Total fuel, acreage, total yield, revenue, etc.

6.5 Your rights

7. Intellectual Property

All Herwitz Mueller IP remains our property, including:

  • Platform code

  • Research

  • Emissions models

  • UX flows

  • Visual elements

  • Benchmark methodologies

You may:

  • View and store your own reports

  • Use them internally

You may not:

  • Resell or redistribute Platform outputs

  • Train competing tools using our outputs

  • Publish our reports externally without permission

8. Payment & Billing (Non-Pilot)

If the Platform introduces paid services:

  • Pricing will be displayed prior to purchase

  • Payments may be processed through Stripe or similar third-party gateways

  • Fees are non-refundable once service delivery begins

  • Subscription services renew unless cancelled

9. Third Party Links & Integrations

The Platform may use or reference:

  • Google Maps or geospatial APIs

  • Industry databases

  • Emissions models

  • Payment gateways

These services operate under their own terms.

We are not responsible for their performance or availability.

10. Liability

To the maximum extent permitted by law:

  • We are not liable for losses arising from use of assessments or reports

  • We do not guarantee accuracy or completeness of outputs

  • We exclude liability for consequential, indirect, or business losses

Nothing in this section limits rights you may have under Australian Consumer Law.

11. Termination of Access

We may suspend or terminate access if:

  • You breach these terms

  • You misuse the Platform

  • You interfere with data or services

  • We discontinue the product

You may stop using the Platform at any time.
